Testamentary capacity is the legal term describing a person’s legal and mental ability to make or alter a valid Will. Without testamentary capacity at the time the Will is executed, the Will is invalid.
As the Donor (the person making the LPA), you must be over 18 years of age and have the mental capacity to make an LPA. Otherwise, the LPA will not be valid or effective.
