Making an LPA is as easy as
1
Book Your Appointment
You can complete the Request a Call Back form or call us to schedule a Home Visit LPA appointment with your estate planner at a time which suits you.
You will then receive a booking confirmation email, outlining the appointment time and date, a process overview and your Instructions Preparation Guide.

Approve Your LPAs
Once you have provided us with all the necessary information, we will produce an initial draft version of your LPAs for you to review.
You can then inform us of any changes you wish to make or confirm you are happy with its contents.

Sign and Register Your LPAs
Once you have your printed LPAs, you need to sign them in front of a witness who will also need to sign them.
You will also need your attorneys, replacement attorneys and certificate provider to sign the LPAs.
You then need to send your signed LPAs to the Office of the Public Guardian for it to be valid and effective.

Am I protected?
LPAs are governed by the Mental Capacity Act 2005.
Your attorneys must act in your best interest at all times. They must assume you can make your own decisions unless it is established that you cannot do so.
They must help you make as many of your own decisions and take all practical steps to help you make these decisions.
Your attorneys must not treat you as unable to make a decision simply because you make an unwise one.

Who is who?
The person making the LPA and giving the decision-making power, is the ‘donor’.
The people to whom the donor is giving the decision-making powers are the ‘attorneys’.
The Certificate Provider is someone signing to confirm that the donor understands what an LPA is and not being forced to make it.
The Certificate Provider is a professional (such as a lawyer, your GP or a healthcare professional) or someone who has known you personally for at least 2 years (such as a friend, neighbour or colleague).
Two LPAs Services
The Two LPAs services are suitable for an individual who wants to have both a Health & Welfare LPA and a Property & Financial Affairs LPA.
The Two LPAs services are also perfect for couples who would like one LPA each. This can be a Health & Welfare LPA for both, or a Property & Financial Affairs LPA for both, or one of each for both.

Who needs to sign my LPA?
To be legally valid, the LPA must be signed in a specific order.
Essentially, the donor must first sign the LPA, followed by the certificate provider, and then the attorneys and replacement attorneys. All of these signatures can occur on the same day.
If the donor is the LPA applicant, then they will also need to sign again at the very end.

The Three LPAs services are suitable for couples where one wants to have both a Health & Welfare LPA and a Property & Financial Affairs LPA, and the other would like just one type of LPA.

Do I need to register my LPA?
Once your LPA has been signed, it must be posted to the Office of the Public Guardian (‘OPG’) to be registered.
The OPG will review the LPA has been made and signed correctly and will then provide you with an original version of your registered LPA with an activation key.
The LPA cannot be used until it is registered.
