What can LPAs do?
You need to choose what type of decision you will need help with.
There are two kinds of LPA, covering two kinds of decision:
Health and Care Decisions
- What medical treatment you receive, such as life-sustaining treatment.
- Staying in your own home and getting help and support from social services.
- Moving into residential care and finding a good care home.
- Day-to-day matters such as your diet, dress or daily routine.
Financial Decisions
- Running your bank and savings account.
- Making or selling investments.
- Paying your bills.
- Buying or selling your house.
- Selling a business
Why making an LPA is important for both you and your family

If you suffer a serious injury or illness, others may need to step in to make decisions on your behalf about your health and finances.
Dementia, Parkinson’s disease or a stroke can render decision-making virtually impossible.
If you lose mental capacity without a valid LPA in place, it can cost your family much time and thousands of pounds to be given permission to handle your affairs.
Any joint bank accounts you hold with your partner would become severely restricted.
This can be devastating, particularly if the joint owner has their income or pension paid into this account, or they use it to pay important bills, such as a mortgage or utility costs.
An LPA gives you more control in these situations by letting you choose now who these people will be and what decisions they can make.
So you can relax in the knowledge that you are choosing people you trust and who will have your best interests at heart.
Can I have both or do I need to choose one?
You can have one LPA or both.
We always recommend having at least one instead of none.
People generally believe that their spouse or civil partner would automatically be able to deal with their bank accounts and pensions, and make decisions about their health and care, if they lose the ability to do so. This is not the case.
An LPA is the only way to ensure that you, your property and your loved ones are looked after if you are not able to do so.
Do I need a lawyer to write an LPA?
Throughout the LPA, there are sections where you might want legal advice which are marked with a lawyer symbol:
However, overall, you do not need a lawyer to make an LPA unless you have unusual or specific requirements.
Tips For Personalising Your LPA
In both LPAs, there is an optional section for you to include your ‘Instructions‘ and ‘Preferences‘.
Instructions tell your attorneys what they must do when acting on your behalf. Instructions cause more problems than preferences.
Financial LPA Instructions
“My attorneys must not consent to any medical treatment involving blood products, as this is against my religion.”
“My attorneys must not decide I am to move into residential care unless, in my doctor’s opinion, I can no longer live independently.”
“My attorneys must instruct a tax accountant to prepare my annual tax return.”
“My attorneys must send annual accounts to my brothers and sisters.”
“My attorneys must continue to donate to charities that I have supported or for which I have set up standing order payments.”

Health and Care LPA Instructions

“My attorneys must consult a financial adviser before making investments over £10,000.”
“My attorneys must not make any gifts.”
“My attorneys must not sell my home unless, in my doctor’s opinion, I can no longer live independently.”
“My attorneys must continue to donate to charities that I have supported or for which I have set up standing order payments.”
“My attorneys must send annual accounts to my brothers and sisters.”
“My attorneys must instruct a tax accountant to prepare my annual tax return.”
Preferences are what you’d like all your attorneys to think about when they make decisions for you. Your attorneys don’t have to follow them but should bear them in mind.
