When an urgent Will is the right call

Our emergency service is for situations where waiting isn’t sensible. That usually means the situations listed here — and it’s just as often a son, daughter, spouse or close friend making the call because the person themselves isn’t well enough to. We’re used to speaking with relatives first, and we’ll guide you through what’s needed.

We take your instructions within 24 hours and have a draft ready within 48 — written in plain English, and read through with you so you’re certain it says what you want.

We oversee the signing

We return with a second independent witness and make sure your Will is executed correctly, so it’s legally valid.

Capacity, handled with care

To make a valid Will, a person needs mental capacity — broadly, an understanding of what they own, who they might provide for, and what signing does. Illness, exhaustion and medication can all affect this, and it varies from day to day.

We assess capacity gently, as a normal part of taking instructions. It isn’t a test. Where illness is serious, we may also recommend a doctor confirms it at the same time — long-established practice that makes the Will much harder to challenge later. A doctor’s assessment is arranged separately and billed at cost.

One honest note: this is a priority service with eligibility criteria, and occasionally a case isn’t one we can properly take on. If that’s true of yours, we’ll tell you quickly and point you elsewhere rather than leave you waiting.

Once the Will is done

Getting the Will signed comes first. Afterwards, there are two things worth knowing about.

A Lasting Power of Attorney lets someone you trust act for you while you’re still alive — often the more pressing document when someone is seriously ill, and it needs the same mental capacity a Will does. And a Will only works if it can be found, which is where safe storage comes in.

We won’t raise any of this while there’s urgent work to do. Ask us whenever you’re ready.

Urgent Will questions

Yes — it’s a routine part of this service. We’re used to working around visiting hours, ward routines and nursing staff, and we’re discreet about it. If there are restrictions on visitors, tell us when you call and we’ll work out what’s possible.

This is more common than people expect, and it doesn’t stop a Will being made. A Will can be signed with a simple mark rather than a full signature, or someone else can sign it on the person’s behalf, in their presence and at their direction. We’ll be there to make sure it’s done correctly either way.

Yes. Speed doesn’t weaken a Will — poor drafting and a bad signing do. This is the same Will writing service we provide to every client, using the same clauses; what’s compressed is our timetable, not the care taken. We oversee the signing ourselves, we bring an independent witness, and where illness is serious we’ll recommend a doctor confirms capacity, which is strong evidence if anyone ever questions the Will.
